Proposed Residential Development - 727 Shoal Point Road
On April 4, 2011, Magnum Opus submitted Official Plan Amendment, Zoning By-law Amendment, and Draft Plan of Subdivision Applications to the Town of Ajax (Town) for lands municipally known as 727 Shoal Point Road, located on the east side of Shoal Point Road, approximately 310 metres south of Bayly Street East. These development applications sought to permit a residential subdivision consisting of 563 dwellings.
These development applications were appealed to the Ontario Municipal Board (OMB) (now the Ontario Land Tribunal – OLT), as the Town had not made a decision on the submitted applications within the prescribed timelines set out in the Planning Act.
A one-day OMB hearing occurred in February 2017, and in July 2017, the OMB issued a decision that approved the Official Plan Amendment, Zoning By-law Amendment, and Draft Plan of Subdivision Applications in principle, but withheld its final order (i.e. official approval) until it received and was satisfied with the final version of the planning instruments (i.e. the Official Plan Amendment, Zoning By-law Amendment, Draft Plan of Subdivision, and the conditions of draft approval of the subdivision). Magnum Opus did not submit the final version of the planning instruments and therefore, a final order from the OMB was not issued.
After the Ontario Municipal Board (OMB) decision, Magnum Opus listed the subject lands for sale.
In November 2022, Weston Consulting, on behalf of Shoal Bayly Ontario Inc. (Shoal), a potential purchaser of the subject lands, provided the Town with development concept plans for 3 of the proposed development blocks within the draft plan of subdivision.
On May 19, 2023, Shoal, with the authorization of Magnum Opus, submitted a revised Official Plan Amendment, Zoning By-law Amendment, and Draft Plan of Subdivision proposal to develop 531 dwellings on the subject lands.
On June 30, 2023, Shoal purchased the subject lands from Magnum Opus and submitted Site Plan Applications for 3 of the proposed development blocks within the proposed draft plan of subdivision to facilitate a condominium townhouse dwelling development on each block.
On April 23, 2024, Shoal filed appeals to the OLT for their Site Plan Applications pursuant to the Planning Act as the Town failed to approve the Site Plan Applications within the 60-day legislated timeline.
A 6-day hearing was held beginning February 18, 2025. This hearing was also utilized to address Shoal’s proposed revisions to the Official Plan Amendment, Zoning By-law Amendment, and Draft Plan of Subdivision.
To-date, the OLT has not issued a written decision on the appeals. Nonetheless, there were no concerns identified with the proposed Official Plan Amendment, Zoning By-law Amendment, and Draft Plan of Subdivision presented at the hearing.
Construction activity on the subject lands will begin with the removal of trees and rough grading of the lands through the submission and issuance of Tree Removal and Sediment and Erosion Control permits. Tree removal and rough grading can occur on the lands without development approvals in place and is regulated through the Town’s applicable by-laws. Through these permits, financial compensation for the removal of trees and financial securities for sediment and erosion control measures, is secured for.
The development proposal currently consists of the following: 525 dwellings – 433 townhouse dwellings (traditional, double fronted, and back-to-back condominium townhouse dwellings), 30 semi-detached dwellings (22 of such are condominium based), and 62 single detached dwellings (freehold, not condominium based).
