Notice of Adoption of Town Initiated Official Plan Amendment No. 71
TAKE NOTICE that the Council of the Corporation of the Town of Ajax passed By-law No. 80-2022 on the 12th day of December 2022 to adopt Official Plan Amendment No. 71.
Official Plan Amendment No. 71 (file No. OPA22-A2) to the Town of Ajax Official Plan implements the following:
- Policy to enable Council to delegate authority to staff to pass by-laws to remove a holding (H) provision, or to establish or extend a temporary use;
- Require submission of a ‘Complete Application’ for Site Plan and Site Plan amendments;
- Update the list of potential technical studies and reports that may be required to be submitted in support of a ‘Complete Application’, such as a Construction Management Plan, Land Use Compatibility Report, Waste Management Plan, Public Consultation Strategy Report, Cultural Heritage Evaluation Report, and Heritage Preservation Plan; and
- Implement policy that allows the Town to require a peer review of technical reports/studies prior to submission of a complete application, if needed.
This is a technical amendment that applies to the entire Town. The Official Plan Amendment and background materials are available for inspection, upon request by contacting clerks@ajax.ca.
The proposed Official Plan Amendment is exempt from approval by the Regional Municipality of Durham and the decision of the Council of the Corporation of the Town of Ajax is final if a notice of appeal is not received on or before the last day of filing a Notice of Appeal. The last day for filing a Notice of Appeal is the 9th day of January, 2023 and the Notice of Appeal must:
- be filed with the Clerk of the Town of Ajax;
- set out the specific part of the proposed Official Plan Amendment to which the appeal applies and set out the reasons for the appeal;
- be accompanied by a $1,100.00 fee made payable to the “Minister of Finance”; and
- be accompanied by a $1,100.00 fee made payable to the “Town of Ajax”.
Only individuals, corporations or public bodies may appeal a decision of the municipality to the Ontario Land Tribunal. A notice of appeal may not be made by an unincorporated association or group. However, a notice of appeal may be made in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submission to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
