Proposed Zoning By-Law Amendment - 527 Kingston Road West
The Town of Ajax is in receipt of the above-noted development application, submitted by 2838033 Ontario Inc., to establish temporary single-use residential permissions (detached dwelling) at 527 Kingston Road West.
The subject lands are currently zoned Village Core Mixed-Use Three (VC3) Zone in the Town of Ajax Zoning By-Law 95-2003, as amended, which permits the following uses: Art Gallery, Office, Personal Service Shop, Retail Store, and Apartment Dwelling units on the upper floor(s) of a building with ground level commercial uses only. Under Section 39 of the Planning Act, R.S.O. 1990, c. P.13, the Council of a local municipality may, through a by-law, authorize the temporary use of land, buildings or structures for any purpose that is otherwise prohibited by the by-law, for a period not exceeding three years. The Council may by by-law grant further periods of not more than three years.
We are offering you the opportunity to review and comment on the Zoning By-law Amendment application prior to its consideration by the Council of the Corporation of the Town of Ajax, at a Statutory Public Meeting to be held on Monday, June 19, 2023 at 7:00 p.m. Ajax Council Chambers, located at Ajax Town Hall, 65 Harwood Ave. S., Ajax, ON.
A copy of the staff report with recommendations to Council on the Zoning Bylaw Amendment application will be available by end of day on Tuesday, June 13, 2023 in the agenda for the meeting, available at ajax.ca/meetings. Alternative formats of documents and materials can be made available upon request in order to assist those who require accessibility accommodations.

This statutory meeting is being held in-person in Council Chambers, located at Ajax Town Hall, 65 Harwood Avenue South, Ajax, Ontario, L1S 2H9, and will be live-streamed for public viewing on our Online Meetings page. Those wishing to make oral submissions can attend in-person and will have 5 minutes to address Council; pre-registration is not required for in-person attendance. If you are unable to attend in-person, electronic remote participation via the Town’s Hybrid Conference System is available as an option and can be arranged by contacting clerks@ajax.ca no later than 12:00 p.m. (noon) on Monday, June 19, 2023.
Written submissions may be provided for Council’s consideration before the meeting. Please submit your written comments before end of day on Wednesday, June 14, 2023, by e-mail to Kanchan Ghadge, Planner at kanchan.ghadge@ajax.ca.
Planning Act Requirements
If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Ajax to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Ajax before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Ajax before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
