Proposed Mixed Use Development - 310 Kingston Road East
Promita Holdings Ltd. is proposing the development of a 25-storey mixed use building consisting of 380 dwelling units and approximately 1,107 square metres of ground floor commercial space. Underground and aboveground parking, within the podium of the building, is proposed to accommodate the development. The lands affected by the proposed development are 310 Kingston Road East.

We invited the public to attend a meeting to comment on Official Plan Amendment Application OPA20-A4 and Zoning By-law Amendment Application Z5/17 prior to consideration of such by Town of Ajax Council. The public/Council meeting was held electronically on June 20, 2022.
Approvals/On-Going Review
Council approved Official Plan Amendment Application OPA20-A4 and Zoning By-law Amendment Application Z5/17 at the June 20, 2022 meeting. Site Plan Application SP8/17 is under review by Town staff and the necessary external agencies. This Application has also been submitted to facilitate the proposed development. The purpose of this Application is to review and examine the design and technical aspects of the proposed development.

Notice of Statutory Public Meeting
This notice is to advise of the opportunity to review and comment on the proposed implementing by-laws for Official Plan Amendment Application OPA23-A2 and Zoning By-law Amendment Application Z2/23, prior to consideration of such by the Council of the Corporation of the Town of Ajax, at a Statutory Public Meeting to be held on Monday, November 27, 2023 at 7:00 p.m.
Official Plan Amendment Application OPA23-A2 and Zoning By-law Amendment Application Z2/23 seek to amend site-specific policies and zoning provisions which were established to regulate the proposed development of a 25-storey mixed use building on the subject lands.
The purpose of Official Plan Amendment Application OPA23-A2 and the proposed implementing by-law is to amend Area Specific Policy 6.34, which was established for the subject lands through Amendment No. 69 to the Official Plan (By-law No. 49-2022). Area Specific Policy 6.34 permits site-specific maximum tower floor plate sizes for the development of a 25-storey mixed use building, subject to the provision of public/social benefits. The proposed implementing by-law for the Official Plan Amendment would increase the maximum tower floor plate sizes and modify the details of the required public/social benefits (rental tenure; and a minimum percentage of barrier-free, family-sized, and affordable dwelling units).
The purpose of Zoning By-law Amendment Application Z2/23 and the proposed implementing by-law is to amend Zoning Exception 208, which was established for the subject lands through By-law No. 50-2022. Exception 208 permits site-specific development standards, including maximum tower floor plate sizes for the development of a 25-storey mixed use building, subject to the provision of public/social benefits. The proposed implementing by-law for the Zoning By-law Amendment would modify site-specific development standards, such as the maximum number of dwelling units and minimum parking spaces permitted, increase the maximum tower floor plate sizes, and modify the details of the required public/social benefits.
The proposed implementing by-laws are being brought forward under the authority of Section 284.11.1 of the Municipal Act and in accordance with Ontario Regulation 580/22, “Provincial Priorities”.

How to Participate
This public meeting is being held in-person in Council Chambers, located at Ajax Town Hall, 65 Harwood Avenue South, Ajax, Ontario, L1S 2H9, and will be live-streamed for public viewing at ajax.ca/live. Those wishing to make oral submissions can attend in-person and will have 5 minutes to address Council; pre-registration is not required for in-person attendance. If you are unable to attend in-person, electronic remote participation via the Town’s Hybrid Conference System is available as an option and can be arranged by contacting clerks@ajax.ca no later than 12:00 p.m. (noon) on Monday, November 27, 2023.
Written submissions may be provided for Council’s consideration before the meeting. Please submit your written comments before 12:00 p.m. (noon) on Monday, November 27, 2023 by using the Comments/Feedback tool below or by submitting an e-mail to clerks@ajax.ca.
Planning Act Requirements
If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Ajax to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Ajax before the proposed official plan amendment is adopted or before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Ajax before the proposed official plan amendment is adopted or before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
