230 and 240 Bayly St. E. - Temporary Use By-law
The Town of Ajax intends to pass a Temporary Use By-law, pursuant to Zoning By-law Amendment Application Z8/26, to establish temporary use permissions for an automatic motor vehicle washing establishment on the lands municipally known as 230 and 240 Bayly Street East (the “subject lands”).
The subject lands are zoned Residential Multiple Four (RM4) Zone with a Holding (H) Provision / Automobile Commercial (AC) Zone with a Holding (H) Provision and subject to Exception 204 in the Town of Ajax Zoning By-law 95-2003, as amended, which does not permit a motor vehicle washing establishment. Under Section 39 of the Planning Act, R.S.O. 1990, c. P.13, as amended, the Town may, through a by-law, authorize the temporary use of land, buildings or structures for any purpose that is otherwise prohibited by the Zoning By-law, for a period not exceeding three years. The Town may, through a by-law, grant further periods of not more than three years.

Planning Act Requirements
Please note that only the applicant, the Minister of Municipal Affairs and Housing, or a specified person or public body, as per the Planning Act, R.S.O. 1990, c. P.13, as amended, may appeal the Town of Ajax’s decision to the Ontario Land Tribunal. In accordance with the Planning Act, R.S.O. 1990, c. P.13, as amended, no third party appeals (i.e. appeals from members of the public) are permitted.
If a specified person or public body would otherwise have an ability to appeal the decision of the Town of Ajax to the Ontario Land Tribunal but the specified person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Ajax before the proposed by-law is passed, the specified person or public body is not entitled to appeal the decision.
If a specified person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Ajax before the proposed by-law is passed, the specified person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the specified person or public body as a party.
If you wish to be notified of the passing of the Temporary Use By-law, you must make a written request to the attention of the Clerk of the Town of Ajax, at 65 Harwood Avenue South, Ajax, Ontario, L1S 2H9 or by e-mail to clerks@ajax.ca.
