Temporary Use By-law - 126, 128, 130, 132, 136, 138, 140, and 142 Commercial Avenue - Ward 3
The Town of Ajax intends to pass a Temporary Use By-law, pursuant to Zoning By-law Amendment Application Z5/25, to establish temporary use permissions for a crisis care facility on the lands municipally known as 126, 128, 130, 132, 136, 138, 140, and 142 Commercial Avenue (the “subject lands”).
The subject lands are zoned Downtown Central Area – Mixed Employment One (DCA/ME1) Zone in the Town of Ajax Zoning By-Law 95-2003, as amended, which does not permit a crisis care facility. Under Section 39 of the Planning Act, R.S.O. 1990, c. P.13, as amended, the Town may, through a by-law, authorize the temporary use of land, buildings or structures for any purpose that is otherwise prohibited by the Zoning By-law, for a period not exceeding three years. The Town may, through a by-law, grant further periods of not more than three years.
On October 29, 2025, Regional Council approved Report #2025-W-34, which states that the Social Services Department wish to extend and expand the Lease for space at 140 Commercial Avenue, in the Town of Ajax, to accommodate a Regional Hub that will provide Income and Employment Services, Family Services, and expanded community resources and support. The Hub will include a 24/7 indoor drop-in space for programming and support services, washroom/shower/laundry facilities, restricted outdoor space, food preparation facilities, winter warming and summer cooling, as well as short-term respite space.

Notice of Passing
On November 17, 2025, Council passed the Temporary Use By-law (By-law 87-2025) pursuant to the provisions of Section 39 of the Planning Act, R.S.O. 1990, c. P.13, as amended. In making this decision, Council had regard for all written and oral submissions that were made relating to this By-law. Please note that, only the applicant, the Minister of Municipal Affairs and Housing, or a specified person or public body, as per the Planning Act, R.S.O. 1990, c. P.13, as amended, may appeal this By-law to the Ontario Land Tribunal (OLT) by filing a Notice of Appeal, no later than 4:30 p.m. on December 11, 2025. In accordance with the Planning Act, R.S.O. 1990, c. P.13, as amended, no third party appeals (i.e. appeals from members of the public) are permitted.
